<p>Harita Nickel has adopted the TNFD framework in its reporting as part of our commitment to managing nature-related risks and promoting transparency in sustainability practices.</p>

<p style="text-align: justify;">Harita Nickel is committed to adhering to national standards and regulations across all operational aspects, including environmental and occupational safety. We strive to exceed Indonesia&rsquo;s regulatory requirements, ensuring responsible and sustainable operations.</p>
<h4 style="text-align: justify;">Environmental Impact Analysis</h4>
<p style="text-align: justify;">Harita Nickel ensures compliance with Environmental Impact Analysis (AMDAL) regulations, aligning with PP No. 22 of 2021 and Permen LHK No. 4 of 2021. This commitment is reflected in our Environmental Management Plan (RKL) and Environmental Monitoring Plan (RPL), developed in collaboration with stakeholders, including local communities, NGOs, academics, and the government.</p>
<p style="text-align: justify;">Harita Nickel's Environmental Impact Analysis covers various aspects, including geo-physics-chemistry (air quality, water quality, and soil quality), biodiversity (protection of flora and fauna and land rehabilitation), socio-economic-cultural (empowerment of local communities and protection of culture), and public health (safety and welfare of the surrounding community).</p>

<p style="text-align: justify;">In the 2024-2025 period, Harita Nickel successfully obtained the Blue PROPER rating, demonstrating full compliance with KLHK's environmental management standards.</p>

<p>IRMA adalah standar pertambangan bertanggung jawab yang paling ketat di dunia. Standar ini mencakup 4 prinsip utama : integritas bisnis, manfaat jangka panjang, tanggung jawab sosial, dan tanggung jawab terhadap lingkungan.&nbsp;</p>
<p>Standar ini disusun oleh masyarakat, buruh terorganisasi, LSM, sektor keuangan, pembeli, dan perusahaan pertambangan, karenanya IRMA menjadi standar pertambangan bertanggung jawab paling komprehensif di dunia.</p>
<p>Harita Nickel adalah perusahaan pertambangan pertama di Indonesia yang secara sukarela menjalani audit berdasarkan standar IRMA.&nbsp;</p>

<p data-start="116" data-end="259"><br>Since 2023, Harita Nickel has been innovating to enable the reuse of nickel slag&mdash;residual material from the processing of saprolite nickel ore.<br><span style="color: rgb(255, 255, 255);">ore<br></span>In 2024, a total of 228,487 tons of nickel slag was repurposed as raw material for bricks, road construction, and artificial reef structures. Additionally, we have begun exploring the use of nickel slag as a planting medium to support reforestation efforts within the Obi Industrial Area.</p>

These cubes are made from concrete mixed with recycled materials, such as nickel slag and fly ash, helping to create new habitats for marine life. <p data-start="190" data-end="510">Our commitment to human rights is embedded in TBP&rsquo;s <strong data-start="242" data-end="265">Human Rights Policy</strong>, which serves as a foundation for identifying and addressing potential human rights risks across our operations and business relationships. This policy guides us in taking proactive measures to prevent and mitigate adverse human rights impacts.</p>
<p data-start="512" data-end="796">Among the key risks we actively work to prevent are: forced or compulsory labor, child labor, human trafficking, unsafe or unfair labor practices, discrimination, violence and intimidation, the restriction of freedom of association, unsafe working environments, and sexual harassment.</p>

Labor Related Human Rights Due Dilligence

<p style="text-align: justify;">Harita Nickel ensures that all working hours comply with Indonesian regulations. Overtime is voluntary, and every employee is entitled to holidays and annual leave.</p>
<p style="text-align: justify;">For field employees, we provide two weeks of leave for every nine to ten weeks of work, with the company covering commuting costs. Additionally, we mandate a rest day for field employees every two weeks to support their well-being.</p>

Working Hours

<p style="text-align: justify;">Most employees residing on-site receive free accommodation along with access to essential services, including meal provisions, laundry, housekeeping, and 24-hour healthcare at our clinic. To further support physical and mental well-being, we also provide sports and religious facilities.</p>
<p style="text-align: justify;">These benefits are extended to both permanent and non-permanent employees, with the exception of health insurance for family members and pension benefits, which are exclusive to permanent staff. Additionally, non-permanent employees are entitled to medical leave, annual leave, and bonuses, including special allowances for celebrations such as Hari Raya.</p>

Allowance

<p style="text-align: justify;">We ensure that entry-level workers in the field receive wages above the minimum standard set by North Maluku province. The same applies to employees at our Jakarta head office, who are compensated above the local minimum wage.</p>
<p style="text-align: justify;">Beyond base salaries, we offer additional benefits, including overtime pay, transportation allowances, daily meals, and professional development opportunities such as language classes.</p>
<p style="text-align: justify;">Additionally, we uphold our sustainability policy by ensuring that all workers&mdash;including contractors and third-party employees&mdash;receive wages above the minimum standard. Competency Development

<p>In the pursuit of upholding human rights principles, PT Trimegah Bangun Persada Tbk (TBP) engaged in human rights due diligence in partnership with the Foundation for International Human Rights Reporting Standards (FIHRRST), starting in September 2023.</p>
<p>As incorporated in the executive summary of our human rights due diligence, we evaluated and addressed potential impacts throughout our operations, supply chain, and engagement with stakeholders, ensuring that human rights considerations remained paramount in our business approach. The assessment has highlighted notable strengths and areas of improvement in TBP's commitment to and practice of human rights.</p>
<p>Taking into account stakeholders' concerns regarding labor conditions in Nickel Mining in Indonesia, we also summarized the findings of the human rights due diligence regarding labor within TBP's operations&nbsp;<a href="https://tbpnickel.com/sustainability/human-rights/our-employee/labor-related-human-rights-due-diligence">here</a>.&nbsp;</p>
<h2>Executive Summary</h2>
<p>In September 2023, PT. Trimegah Bangun Persada Tbk. or "The Company" or "TBP" invited the Foundation for International Human Rights Reporting Standards (FHIRRST) to undertake a Human Rights Due Diligence (HRDD) process. The purpose of the HRDD was to:&nbsp;</p>
<ol>
<li>Assess the level of compliance of the Company&rsquo;s policies, procedures and performance with international human rights standards and best practices for business operations;&nbsp;</li>
<li>Identify human rights actual and potential impact areas within and across the various business units of TBP;&nbsp;</li>
<li>Rank the severity and prevalence level of each impact.</li>
</ol>
<p>FIHRRST&rsquo;s Human Rights Due Diligence (HRDD) process refers to operational principles of the United Nations Guiding Principles on Business and Human Rights/UNGPs (Principles 17 to 21 and 24) to identify, prevent, mitigate and account for potential and actual adverse human rights impacts related to a company&rsquo;s business operations, created either through its activities or as a result of its business relationships.</p>
<p>At the time of the HRDD, the Company had developed four business units and affiliated companies, namely PT Gane Permai Sentosa (GPS), PT Megah Surya Pertiwi (MSP), PT Halmahera Persada Lygend (HPAL), and PT Halmahera Jaya Feronickel (HJF) &ndash; which are nickel &amp; cobalt mining and ore processing units.</p>
<p>Unit-level management teams, factory workers and other key personnel were actively engaged during HRDD process. Other stakeholders, such as trade union representatives, government authorities, community representatives, local NGOs and other business partners, were consulted during the assessment process.</p>
<p>During HRDD activities, stakeholder engagement is considered a cross-cutting component for every phase of an HRDD process, since human rights risks may be associated with a company&rsquo;s business activity.</p>
<p>Overall, the Company has shown adherence to both nationally and internationally recognized and regulated human rights standards, internally and externally. The assessment identifies significant strengths and areas of improvement in TBP's commitment to and practice of human rights.</p>
<p>First, the Company had embarked on a comprehensive journey towards implementation of safety and health best practices. Clearly defined measures to protect workers' health and safety are stipulated in the Company&rsquo;s occupational health, and safety and environmental policies, and practices.</p>
<p>Some business units had already received ISO450001 &amp; SMK3 certification and others were moving towards achieving these certifications, emphasizing the importance of this area to the company. ISO45001, is an international standard that specifies requirements for an occupational health and safety (OH&amp;S) management system, while SMK3 (Sistem Manajemen Keselamatan dan Kesehatan Kerja) is a widely recognized Indonesian health &amp; safety certification.</p>
<p>However, there is still room for improvement in health &amp; safety-related practices. For example, the establishment of collaboration with contractors and communities would make the company&rsquo;s health &amp; safety programme more inclusive and cohesive.</p>
<p>Internally, the Company has demonstrated best practices regarding labor-related issues. Protection of workers' rights is ensured by providing written and understandable employment contracts detailing wages, working hours, rest time, benefits, as well as terms and conditions of the employment relationship.</p>
<p>Housing facilities for workers on the operational site are adequate, and additional services, like entertainment and sports facilities are provided. Yet, some areas of concern emerged from business partners and contractors. Consequently, collaboration with contractors and business partners is considered crucial.</p>
<p>Second, externally, the Company has conducted an Environmental Impact Assessment and communicated the results to the community. The Company offers medical services in local villages and keeps track of the health of the community, on issues related to resettlement and environmental protection. Similarly to the health &amp; safety programme, these efforts can be enhanced by strengthening the Company&rsquo;s engagement with the community, especially in determining remedy measures.</p>
<p>Furthermore, the company's touch points with the community have evolved and already include a grievance system (Saluran Aspirasi Masalah/SALAM) with dedicated grievance forms and community interaction procedures (Sarana Komunikasi Masyarakat/Sarakia), which are both managed by dedicated staff engaging regularly with local villagers. Therefore, the Company is well informed about the community&rsquo;s needs and concerns, which enabled the development of a positive relationship.</p>
<p>Yet, there is a need to make engagement with key stakeholders more inclusive, and create joint environmental monitoring activities that are conducted in partnership between the company and communities.</p>
<p>The issues of community health and safety, resettlement, and environmental protection are prominent in the Kawasi and Soligi villages that are located near the Company&rsquo;s operations.</p>
<p>Concerning the planned resettlement of Kawasi, the Company should strengthen the engagement and consultation with the community to determine a fair remedy scheme. In addition, community health and safety issues are rooted in improper in-migration management.</p>
<p>As the Company will expand its operations, the Company must collaborate with the government in spatial planning and housing management in light of increasing transmigration of population from surrounding areas looking for employment and earning opportunities.</p>
<p>Additionally, the assessment highlights the importance of inclusive stakeholder engagement and joint environmental monitoring activities between the Company and communities in Kawasi and Soligi Villages.</p>
<p>This is crucial to ensure environmental protection and to address any rumors that could potentially harm the community and Company's reputation.</p>
<p>Third, the HRDD also evaluated how adverse human rights impacts are addressed and tracks the Company&rsquo;s responses to prevent and mitigate any future impacts. An example of a result of this assessment was that, although the Company has developed policies and standards to implement respect for human rights in its supply chain, much work is still needed to establish effective monitoring of the human rights performance of suppliers.</p>
<p>Examples of recommended improvement measures in this area include building a cross-functional supply chain management system, dedicated human rights training for procurement-related activities, awareness raising for business partners, among other measures.</p>
<p>In sum, this report has resulted in a time-bound action plan for the Company to address both potential and actual human rights impacts.</p>
<p>However, it is important to emphasize that the Company should conduct annual assessments to ensure that the risks and impacts are effectively addressed according to the proposed action plan.</p>
<p>This ongoing evaluation process is essential to adapt to changing circumstances, monitor progress, and continuously improve the Company's approach to human rights management.</p>

Human Rights Due Diligence

<p>Harita Nickel's dedication to upholding human rights is articulated in its <a href="https://tbpnickel.com/sustainability/human-rights" target="_blank" rel="noopener"><strong>Human Rights Policy</strong></a>. This policy provides a foundation for Harita Nickel to address human rights risks by implementing proactive measures to mitigate potential adverse impacts resulting from its operations and business relationships. Among the human rights risks and impacts proactively prevented are forced or compulsory labor, child labor, human trafficking, unfair occupational health and safety practices, discrimination, violence and intimidation, union suppression, unsafe working environments, and sexual harassment.</p>
<p>The Harita Nickel's Human Rights Policy includes a statement about respecting human rights by international human rights instruments including UNGP Principles 12 namely:&nbsp;</p>

<p>The HRDD addresses various human rights issues, but this article specifically centers on labor rights.</p>
<p>The HRDD scope related to labor rights included the following areas:&nbsp;&nbsp;</p>
<h2>1. Abolition of forced labor&nbsp;</h2>
<p>The International Labor Organization (ILO) outlines 11 indicators that define forced labor (ILO Indicators of Forced Labour, 2012), comprising :&nbsp;</p>
<ul>
<li>Abuse of vulnerability</li>
<li>Deception</li>
<li>Restriction of movement</li>
<li>Isolation</li>
<li>Physical and sexual violence</li>
<li>Intimidation and threats</li>
<li>Retention of identity documents</li>
<li>Withholding of wages</li>
<li>Debt bondage</li>
<li>Abusive working and living conditions</li>
<li>Excessive overtime&nbsp;</li>
</ul>
<p>The Human Rights Due Diligence related to forced labor is conducted by assessing the practice within the Company against the above indicators.</p>
<h3>HRDD Findings on Good Practice in Managing the Risk of Forced Labor</h3>
<p>The documents review and interviews with employees and contractors&rsquo; workers show that there is no forced labor associated with the mine. The commitment to abolishing forced labor is reflected in the Company&rsquo;s Draft of Human Rights Policy, Group Sustainability Policy, and Internal Memo on Human Rights Policy Commitment. The Company has implemented its commitment through the following measures:&nbsp;</p>
<ul>
<li>Providing written and understandable employment contracts detailing wages, duration of the work, working and rest time, benefits as well as terms and conditions of the employment.</li>
<li>Prohibiting retention of identity documents or other valuable personal possessions.</li>
<li>Prohibiting the use of threats of physical punishment, harassment, and intimidation against the employees or his/her family with the aim of coercion or disciplinary measures.</li>
<li>Applying working hours as prescribed by national law. In addition, employees have a roster working arrangement (e.g. nine weeks working and two weeks off) and have the right to leave as mandated by national legislation. Employees may also take special leave for special circumstances (30 days).</li>
<li>Ensuring the contractors and subcontractors provide employment contracts to their workers.</li>
<li>Paying the employees that meet or exceed the applicable regulations or living wage.</li>
<li>Prohibiting compulsory overtime. Based on interviews with workers, every non-staff worker /crew who is required to work overtime must fill out a consent form in advance. Moreover, workers unwilling to work overtime due to specific reasons and circumstances may refuse overtime work requests.</li>
</ul>
<h2>2. Abolition of child labor</h2>
<p>Child labor remains prevalent in the mining industry, particularly in gold, tin, and sand mining operations. Additionally, it persists within the construction sector. Although children might not be directly employed as construction workers, they might engage in ancillary roles, such as cleaning tasks at worker accommodation sites (Bureau of International Labor Affairs, 2022; Hidron, C. and Koepke, R., 2014).&nbsp;</p>
<h3>HRDD Findings on Good Practice in Managing the Risk of Child Labor</h3>
<p>The Company has demonstrated its commitment to the elimination of child labor as reflected in the Company&rsquo;s Draft of the Human Rights Policy, Group Sustainability Policy, Company Regulations, and SOP Recruitment. The Company sets a minimum age limit of 18 years for recruitment, except for dump truck operators, who must be a minimum of 21 years old.</p>
<p>The Company provides training on policy and procedures related to the abolition of forced labor and abolition of child labor to the employees including employees of contractors.</p>
<h2>3. Freedom of association</h2>
<p>TBP does not have labor unions, as an alternative, the company has established Lembaga Kerja Sama/LKS (Cooperation Organization) Bipartite. The establishment and function of LKS is also stipulated in the company regulation.&nbsp;</p>
<h3>HRDD findings on&nbsp;Good Practice in Freedom of Association<em>&nbsp;</em><strong><br></strong></h3>
<p>The Company upholds the freedom of association, as outlined in both the Company&rsquo;s Draft of Human Rights Policy, Group Sustainability Policy and in compliance with the ILO convention ensuring the rights to establish association. The Company allows employees to create an alternative mechanism, known as Lembaga Kerja Sama/LKS (Cooperation Organization) Bipartite, to voice grievances and safeguard their rights.</p>
<p>In addition to findings on the good practices on compliance with human rights principles related to labor, the due diligence identifies salient human rights issues and provides mitigation recommendations, as outlined in the following table.&nbsp;&nbsp;</p>
